RCW 9A.36.031 designates assaulting a Police Officer a Class C felony, which can only be charged by a County Prosecutor. If a County declines to file felony charges, the City is left with two options: 1) either charge the suspect with assault 4, which doesn't account for the victim's status as a Police Officer; or 2) charge the suspect with attempted assault 3, which is legally and factually confusing.
This Ordinance would create a new section to the Auburn City Code that would allow City Prosecutors to file misdemeanor charges against a suspect who assaults a City Police Officer, Code Enforcement Officer, Parking Enforcement Officer, or Animal Control Officer. |
